Need Help with a False Arrest Lawsuit

I was arrested in Detroit on drug charges. This was a false arrest and they locked me up. I have never dealt drugs before and I can say this is true. When I was hanging out at a bar the cops came in and started breaking up some things that were going on around me. I wasn’t doing anything wrong. They took me along with 5-6 of my friends and started to question us. During the questioning one of the cops found a little bag of H and I was immediately arrested because it was near my coat that was sitting in the booth.

I told all the cops that it wasn’t mine and they question me why I was hanging there. There was no proof at all at the time. I spent the night in jail and charges had been filed against me. It was my first charge ever because I’ve never been in trouble at all. The next day I made bail and I was out of there. One of the fellows we were hanging with went to court last week and admitted that the drugs the found were his. He didn’t mention anything about me and I told my lawyer.

We are going to get the charges dropped but I’m not finished with this. I am going to file a lawsuit against the department for a false arrest because they had no evidence of me ever doing anything and they assumed it was my stuff and even locked me up. I told my attorney and he told me that I need to hire an attorney that files suits. Can you advance me an money for this right now?

Our underwriters will need to look at your case prior to making a decision on an approval. Sounds like you have a pretty solid case so chances are good that you would be approved but again without looking at your case, I can’t give you a definitive answer.

  11. i was arrested yesterday on a warrant that had already been recalled by the courts a week earlier. when arrested i showed the police officer a copy of my court documents showing that the warrant had been recalled by the judge. when he called to confirm the warrant they did not check and told the officer it was still active. i was then held for 5 hours and then picked up by the issuing county for transport. halfway through the transport i was released in whatever county we were in and left there. i was never given a phone call (that could have cleared the confusion in minutes) and my question is would i qualify for a lawsuit for false arrest?

  12. I plead no contest to simple battery (MM) in 1998. I been off probation for years I took a gun to the pawnshop to trade for an upgraded model. The gun was purchase by my wife. The cops were called because the background check didnt pass. They asked have I ever been convicted of a felony and I told them NO. They said it showed I did and I was placed under arrest. I explained to the officer to call the courthouse in Fl and they could clear it up. Im out today and I got a copy of my charge sheet and it CLEARLY says nolo to simple battery. Do i qualify for a lawsuit like i said one phone call to the courthouse would have cleared this up but the police refused.

  13. I was arrested in November of 2009 on trafficking cocaine charges in Aiken County South Carolina by a state trooper. This was my first charge ever.   14. Charlie, I would contact an attorney regarding your case. I’m not too sure if you have a case against the state if the charges were dropped. Paul, I’m not sure if you qualify for a lawsuit or not. I would also contact an attorney regarding this question. You both may want to contact an attorney that specializes in false arrest etc. You will also benefit from contacting an attorney in your respected states.

  15. (cont. of Paul May 6, 2010) I can to realize that now I was arrest because the FDLE disposition dept input my conviction wrong. Instead of simple battery (MM) it was listed as Sexual Battery (F) I went for years not voting and not owning a firearm, I applied for several Law Enforcement jobs and one job for the school board. I was basically a shoe in for these jobs because of my experience for job with school board and because of height and size with Law enforcement. The DA is dropping the charges but that arrest has bought me a lot of shame, depression, and finicial hardship due to paying the bondmen. Do I have a cause against the FDLE for improper information on my record which lead to a false arrest…..

  16. charlie if you got out by method of bondsmen you will not get any of your money back a small percent goes to the institute that housed you and the rest to the bondsman for his serves but if it was a cash bond you can get majority or all of your money back but it will take a while.
